Abstract

The difference in approach and semantics notwithstanding, investigating, and sanctioning cartels has formed a significant part of the operations of the Competition Commission of India (CCI) and the Competition Commissions of Pakistan (CCP) in the approximately ten years that these authorities have been in operation. This chapter examines and compares the various aspects of cartel enforcement in India and Pakistan. To this end this chapter is organised as follows: section 1 sets out the legal regime for proceeding against cartels in the two countries and compares these with their EU and US antecedents and to each other; section 2 provides an overview of cartel enforcement in India and Pakistan; section 3 examines and compares the decisions of the CCI and the CCP in respect of various types of cartels; and section 4 observes how decisions of the CCI and CCP have fared in appeals. The final section concludes.
