Navigating the Cryptosphere: Jurisdictional Uncertainty in Emerging Cross-Border Cryptocurrency Disputes

Research output: Chapter in Book/Conference proceedingChapterpeer-review

Abstract

The rise of cryptocurrencies has brought about a transformative shift in the global financial arena, leading to increased cross-border transactions through exchange platforms and decentralised autonomous organisations (DAOs). However, the borderless nature of crypto transactions, coupled with the absence of international legal frameworks for cross-border dispute resolution, introduces uncertainties in the resolution of crypto-related disputes. This chapter examines the jurisdictional issues associated with cryptoasset transactions executed via decentralised and exchange platforms, along with the obstacles in enforcing judgments stemming from these disputes. The chapter highlights the need for international cooperation and harmonised regulations to address these challenges effectively.
