Abstract

Comments on Hasan Kose v Turkey (15014/11) (ECtHR) on whether the imposition of a suspended custodial sentence on a police officer for shooting the applicant in the abdomen whilst in police detention, amounting to use of disproportionate force endangering life, breached his rights under ECHR art.2. Questions the finding that it was unnecessary to examine a complaint about use of tear gas under art.3.
